Captain Marvel can't be Marvel character

 Because...



He only fights villains and not other heroes.

To be fair, DC made sure to "fix" that as soon as they got their hands on the license. Certainly, outside of dedicated Marvel Family books, DC's primary use for the Marvel Family (or ersatz Marvels) was to have them fight mainstream DC heroes before having them join forces. There's a part of me that wants to think that was a sly jab at the competition, but...

They are (expies of) the heroes and protagonists from newspaper comics strips, who have gone on strike.
